I booked a flat in badlapur in Smaruddhi Evergreens(Builder – Poddar Housing) on 16-08-2013. and at the time of booking project was 80% complete. When i have cleared all my dues and asked for possession letter they told me that i have not cleared all the dues on time hence you have to pay interest on delay payment.
When i saw the interest letter they have charged the interest (Rs- 53000) to me from the date of registration i.e 15-10-2013 wherein i got the agreement from builder on 14-11-2013 alongwith 1st demand letter. As per rules they should have given me time to arrange the fund… There should be some buffer time after giving 1st demand letter… As flat was 80% complete at the time of booking and they have asked me to pay approx.12.40 Lacs in 1st demand letter… After receiving the agreement from bulider i have submitted the same to ICICIBANK for loan disbursement…. they also need time to verify agreement and others details …. it took time i got the check from bank on 31-12-2013.
They have not given me the time to arrange the fund instead they have charged the delay payment interest form date of registration.
How can they charged me interest from date of registration when i have got agreement and 1st demand letter on 14-11-2014 ?also How bank will release the loan amt without agreement ?
I dont understand logic behind their calculation…
When i met him i explained him the same…but he is not ready to understand…
Also i asked him if you want to charged me interest on delayed payment then considerthe date of agreement and 1st demand letter and exclude your buffer time and then calculate the interest ……but that also he is not listening…
Plz suggest what to do? it is very big amount for me to pay…
