Respected Sir/Madam, I Dr. Rashmi Gore, booked office space 103, Sai Yash Jewel, S. NO. 40/5B+6A, Pune thergaon road, Near Dange Chowk, Thergaon, Pune (project by Sai erectors, Vaishanavi group) on 19/08/2015. I had given SBI cheque for booking amount 10Lac in favor of Sai Erectors. I was interacting with Mr. Jitu Punjabi 9822248000, 02065106800. Below are the series of events •At the time of booking builder representative, Mr. Jitu Punjabi, told me that all the project documents are available and project is clear title. He mentioned me that building plan is approved and construction is carried out as per the plan •Builder gave me documents after 8 days after my multiple follow ups. When I went through the documents, I noticed that building layout plan is old and plan approval is given by pimpri chinchwad muncipal corporation on 27/02/2008. I also noticed that construction carried out at the site is not as per the plan and I raised the concern to builder to produce the correct documents •Builder representative, Mr. Jitu Punjabi, told me that revised plan is submitted to pimpri chinchwad muncipal corporation and is in the process to get the approval. This is first time when I was notified that the plan is under revision. •I visited pimpri chinchwad muncipal corporation office and enquired about the revised layout. Mr. Borse, engineer in charge at pimpri chinchwad muncipal corporation mentioned that he has not received any revised plan for the said project. He also guided that if construction is not as per plan, I should not proceed with this deal •I visited architect office, Yojana Architect (Proprietor Mr. N.D. Joshi) at vishal nagar, aundh- hinjewadi road and enquired about if architect has prepared any revised plan. Architect representative mentioned that plan is with builder and builder needs to follow up with pimpri chinchwad muncipal corporation for submission/approval •I visited Mr. Jitu and informed about my visit to architect and pimpri chinchwad muncipal corporation office. He mentioned that file is under process and we should get approval within one month •I informed Mr. Jitu Punjabi that if he can get revised plan in a month’s time, we will wait before we execute the agreement to sale. He denied to this proposal and demanded for more money before the agreement. He also mentioned that he is ready to sign mutual agreement and will give in written that he will produce the blue print within a month. I told him that if he is not ready to wait, we will not proceed with this deal. •I gave him in written on 23rd Sep 2015 to cancel this deal and refund the booking amount. He agreed for cancellation and gave me cheque dated 27th Oct2015 with amount 9, 50, 000 INR. I asked him 1. reason for deduction of 50, 000INR? 2. reason for delay in refund. To this, he informed that it is standard refund process which every builder follows to deduct the amount and refund will not be immediate. I informed him that cancellation is due to the technical glitch (revised layout is not available) and he should refund the full amount to which he did not agree •I deposited the cheque on 27th Oct 2015 which was returned on 29/10/2015 with reason FUNDS INSUFFICIENT. •I contacted builder representative, Mr. Jitu Punjabi and he informed me to deposit the cheque after 12 days. •I deposited the cheque again on 11th nov 2015 and it was again returned on 12 Nov 2015 with reason FUNDS INSUFFICIENT. •I again contacted builder representative, Mr. Jitu Punjabi and he mentioned on 15th Nov 2015 that he will transfer the refund through NEFT. I SMS him account details and reminded him multiple times to refund the amount. Till date on 27th Nov 2015, he has not transferred refund. Now he has stopped responding to the calls I am looking forward for action from consumer complaint council to get full refund with interest and with penalty for delay in payment from builder.
