I had booked a 2 BHK flat on 14th October 2013 in a housing project called Dreamz Swadesh promoted by M/s Dreamz Infra India Pvt Ltd, having its office at No:577/B Outer Ring Road, Teachers Colony, Kormangala, Near Silk Board, Bangalore-560034. I also made a payment of Rs.2,50,000/- vide SBI cheque no 772830 dt.14/10/2013. Further on demand in Aug 2014, an amount of Rs.23,750/- towards service tax on amount paid at the time of the booking was paid as demanded vide HSBC cheque no 300807 dt 22/08/2014.
Since the project was getting delayed and nothing had moved till April(18 months since it was booked),I cancelled my booking on 25th April 2015.They asked that they would get in touch once the refund cheque was ready.
They informed me in the !st week of June to collect the cheque issued agains refund of booking amount from their office at HBR Layout, Near Bheema Jewellers. Undersigned visited their office and were handed over a posted dated cheque of Rs 2.73,750/-, dated 10.08.2015 drawn on Bank Of India, Bangalore SSR branch, as per the clause in MOU which said refund to be made after 90 working days! However when the aforesaid cheque was presented for clearance, it was dishonoured, the reason being insufficient funds in the account.
Undersigned upon getting the written intimation from the bank, wrote e-mails & sent registered letters to their office along with the demand notice under sec 138 of the NI act 1881 seeking refund of the amount. There has been no reply from the company & neither have they contacted me.
Under such circumstances, I have no alternative but to seek the help of the Consumer Forum. Kindly look into the matter and penalize the company by making them return the amount with interest accumulated since the day of booking amount received, as this will be the right way to deal with the crooks.
