I the undersigned has purchased a Micromax Canvas Nitro A311 mobile from an online retailer ebay on 09/06/2015 using credit card. The product was faulty from the day I received it. Multiple problems in the device relating to hardware & software both. The device serious technical issues and it right to say that Micromax mobile had manufacturing defect or it was refurbished. I had nothing but paperweight in my hand.
I contacted ebay through email to ask for a refund of money as they were offering 30 day ebay gurantee. After few days ebay declined my request for refund on pretext that this device is under manufacturer warranty and we can not refund. Finally I visited Micromax service center on 29/06/2015 with Job sheet ref no: N030716-0615-17584927. To my surprise Micromax offered my to repair the handset by updating software, I explained the whole situation to the person attending me and requested them to get it replaced as this handset has multiple technical issues and manufacturing defect. I somehow managed to make them agree for a replacement but they have asked me to wait for 3-4 weeks to get it replaced. This is something which a consumer would never like. Have I spent 9399/- to buy headache? Ebay did not support in any way and now Micromax adding fuel to the fire. I wonder do we have any law and regulation for these sellers and manufacturers? Is Indian govt allowing manufacturers to sell anything with any social and moral responsibility? Do we have any authority or regulatory body who can really help consumers?
I request you to kindly intervene in this matter and suggest appropriate legal action against ebay and Micromax.

We at eBay provide 30 days of purchase protection i.e. eBay Guarantee*.
But as per eBay policies products with Manufacturer warranty are excluded from eBay Guarantee* coverage as you can visit nearest Authorized service center of the Brand and get the issue resolved. So we would request you to visit the nearest service center and get the issue resolved.
