I had booked a floor with Omaxe Ltd for Omaxe Swarnaprastha Floor Sonepat Haryana and paid Rs. 6 lakh in Jul 2011. I was informed that timeline for buyer builder agreement, home loan and possession are 1, 2 & 12 months. Till now no home loan is available and they are continuously raising demands of installments and I have paid more than 22 lakhs till now. Date of offer of possession is indefinite. Now they are forcing me to sign an unfair, one sided, binding buyer builder agreement. I am told that no home loan and possession will be offered without signing this agreement which is standard and not amendable. I spoke and wrote many times to endorse my T&C in the agreement which are not agreed to. The agreement sent by Omaxe Ltd to me is providing every way for evasion to builder for every fault and binding on buyer for every thing to accept as it is. Agreement is prepared with malafide intentions and is a trap for customers. Through your forum, I request to (1) get the agreement incorporated with my T&C which are sent to Omaxe Ltd, (2) builder to pay compensation for delay from Jul 2013 onward, (3) no further installment to be demanded without home loan, (4) a separate agreement exclusively for home loan which should include terms of payment and timelines for offer of possession only is to be prepared, (5) the status of project along with probable date of offer of possession is to be informed every month to customers.
